Limitation period
(1) The imposition of punishment and measures (section 11(1) No 8) shall be excluded on expiry of the limitation period. Section 76a(2) 1st sentence No 1 remains unaffected.
(2) Felonies under section 211 (murder under specific aggravating circumstances) are not subject to the statute of limitations.
(3) To the extent that prosecution is subject to the statute of limitations, the limitation period shall be
1. thirty years in the case of offences punishable by imprisonment for life;
2. twenty years in the case of offences punishable by a maximum term of imprisonment of more than ten years;
3. ten years in the case of offences punishable by a maximum term of imprisonment of more than five years but no more than ten years;
4. five years in the case of offences punishable by a maximum term of imprisonment of more than one year but no more than five years;
5. three years in the case of other offences.
(4) The period shall conform to the penalty provided for in the law defining the elements of the offence, irrespective of aggravating or mitigating circumstances provided for in the provisions of the General Part or of aggravated or privileged offences in the Special Part .

Verjährung der Strafbarkeit
§ 57. (1) Strafbare Handlungen, die mit lebenslanger Freiheitsstrafe bedroht sind oder die mit Freiheitsstrafe von zehn bis zu zwanzig Jahren oder mit lebenslanger Freiheitsstrafe bedroht sind, verjähren nicht. Nach Ablauf einer Frist von zwanzig Jahren tritt jedoch an die Stelle der angedrohten lebenslangen Freiheitsstrafe eine Freiheitsstrafe von zehn bis zu zwanzig Jahren. Für die Frist gelten Abs. 2 und § 58 entsprechend.
(2) Die Strafbarkeit anderer Taten erlischt durch Verjährung. Die Verjährungsfrist beginnt, sobald die mit Strafe bedrohte Tätigkeit abgeschlossen ist oder das mit Strafe bedrohte Verhalten aufhört.
(3) Die Verjährungsfrist beträgt
zwanzig Jahre,
wenn die Handlung zwar nicht mit lebenslanger Freiheitsstrafe, aber mit mehr als zehnjähriger Freiheitsstrafe bedroht ist;
zehn Jahre,
wenn die Handlung mit mehr als fünfjähriger, aber höchstens
zehnjähriger Freiheitsstrafe bedroht ist;
fünf Jahre,
wenn die Handlung mit mehr als einjähriger, aber höchstens
fünfjähriger Freiheitsstrafe bedroht ist;
drei Jahre,
wenn die Handlung mit mehr als sechsmonatiger, aber höchstens
einjähriger Freiheitsstrafe bedroht ist;
ein Jahr,
wenn die Handlung mit nicht mehr als sechsmonatiger Freiheitsstrafe
oder nur mit Geldstrafe bedroht ist.
(4) Mit dem Eintritt der Verjährung werden auch der Verfall und vorbeugende Maßnahmen unzulässig.

Omezení zhasne trestného činu:
1) za dvacet let, jde-li o trestný čin, na který zákon stanoví trest odnětí svobody, který není menší než dvacet čtyři let;
2) patnáct let, jde-li o trestný čin, na který zákon stanoví trest odnětí svobody v délce nejméně deseti let;
3) za deset let, jde-li o trestný čin, na který zákon stanoví trest odnětí svobody na méně než pět let, nebo trest pokuty.
4) za pět let, pokud to je zločin, za který zákon stanoví trest odnětí svobody kratší než pět let nebo peněžitým trestem;
5), ve třech letech, kdy se jedná o trestný čin, na který zákon předepisuje termín zatčení;
6) ve dvou letech, kdy se jedná o trestný čin, na který zákon předepisuje trest pokutu.
Chcete-li určit dobu potřebnou k vám předepsat s ohledem na maximální pokuty stanovená zákonem pro trestný čin, nebo pokus o, s přihlédnutím k maximální trest stanovený za přitěžujících okolností a snížení minimální stanovenou pro polehčujících okolností.
